1.These Terms of Use set out the terms and conditions that govern your access and use of Adaremit websites and applications, whether through an individual account or a business account. These Terms are effective from the first time you register or use our services. If you do not agree to some or all of the contents of these Terms of Use, then you are not allowed to access, register, or utilize the services provided by Adaremit.
2.These Terms of Service are effective from the first time you access, register, or use the services provided by Adaremit. We reserve the right to review and amend the contents of these terms at any time in accordance with our policies. Any changes will be notified to you in advance, and such changes will be effective within a period of 14 (fourteen) calendar days from the date the notice is given.
3.Adaremit services are designed to provide ease in the process of sending and receiving funds globally. All fees displayed and charged to users are determined based on the principle of fairness and in accordance with the provisions of applicable laws and regulations.
4."Adaremit", "we", "us", and "our" as used in these Terms of Service refer to Adaremit, a non-bank financial institution operating in Indonesia and having obtained a license from Bank Indonesia to conduct remittance business activities, based on license number 12/68/Mdn/7. Adaremit's registered office is located at Jl. Iming No. 4T, Medan City, North Sumatra, 20216. Adaremit has the status of a Payment Service Provider licensed and supervised by Bank Indonesia.
5.The terms "you" and "your" in these Terms of Service refer to any individual who accesses, uses, or registers as a user of Adaremit services, including but not limited to visitors to Adaremit official sites and/or applications.
6.Please note that we will do our best to send your money on time. If you are dissatisfied with the services we provide, please contact our Customer Support Service. We will endeavour to resolve your complaint promptly, professionally, and in accordance with applicable procedures.
CUSTOMER OBLIGATIONS
1.Age Requirements and Legal Capacity
In order to be able to register and use Adaremit services, you represent and warrant that you are at least 17 (seventeen) years of age and have the legal right, authority, and capacity to access and use the services and are subject to these Terms of Service.
2.Legitimate and Responsible Use of the Service
You are obliged to access and use the service only through lawful means and for lawful purposes in accordance with the provisions of applicable laws and regulations. You are prohibited from using the service to upload, send, store, or disseminate material that is unlawful, deceptive, or intended to commit fraud of any kind.
3.Payment of Service Fee
In connection with the execution of the transaction, you agree to make payment of the applicable service fees and other charges, as determined and informed by Adaremit in the course of the transaction.
4.Transactions for Personal Interests
You and the recipient of the transaction are obliged to act on behalf of and for their respective personal interests. You are not allowed to send or receive funds on behalf of third parties.
5.Prohibition of Acting as a Remittance Service Provider
You are not allowed to act as a remittance service provider or carry out remittance activities on behalf of any other party in any form while using Adaremit services.
6.Account Confidentiality
You are responsible for maintaining the confidentiality and security of your account, including but not limited to passwords, identity credentials, and other information provided by Adaremit. You are not allowed to disclose such information to any party.
7.Account Transfer Prohibition
You may not provide access to others to use your identity or user status, and you may not transfer, assign, or transfer your account to any individual or entity.
8.Identity Verification
You agree to provide Adaremit with such identity documents and other supporting documents as may reasonably be required to comply with applicable compliance and regulatory requirements.
9.Official Payment Account
Each payment is only made to an official account, namely in the name of PT Anugrah Danamas Remit which is clearly stated in the transaction details on the Adaremit platform. Any form of payment made to an account other than that specified is beyond our responsibility and is not an account owned or controlled by Adaremit.
10.The Obligation to Provide Correct and Up-to-Date Information
You are obliged to provide accurate, up-to-date and complete information as required in the use of the service, and to periodically update such information during the course of the transaction.
11.Compliance with Applicable Law
You represent that you will comply with all applicable laws and regulations, whether in your country of residence or in the country, province, or jurisdiction in which you use Adaremit services.
RIGHTS AND OBLIGATIONS OF ADAREMIT
1.Service Availability and Geographical Service Operational Limitations
Adaremit states that the availability of services may be limited, either partially or fully, in certain regions or countries. For now, the remittance service is only available for remittances from Indonesia to other countries supported by the Adaremit system. We do not guarantee that the service is available in all jurisdictions.
2.Access to the Services
We will use our best efforts reasonably to ensure the availability of access to the Adaremit site and/or application at all times. However, we do not guarantee that such access will not be interrupted, delayed, or interrupted due to technical malfunctions, system maintenance, or events beyond our control.
3.Transaction Processing
We will process your transaction as soon as possible after we have received all the necessary information and verification. However, there is a possibility that certain transactions may experience delays or cancellations due to technical, regulatory, or other reasons. In the event of any delay or cancellation, we will endeavour to contact you as soon as possible.
4.Notification to Users
Any notification related to transactions or use of services may be delivered to you via email, application notifications, or other means of communication. We also provide up-to-date information regarding services through Adaremit official website and/or application.
5.Accuracy of Service Information
We strive to provide accurate and up-to-date information on our site and application. However, in the event of a typo error, technical error, or delay in updating the information, we are not liable for any losses incurred as a result of actions taken on the basis of such information, to the extent permitted by applicable law.
6.Transaction Rejections, Restrictions, and Delays
In order to comply with our legal obligations, regulatory compliance, and internal policies, Adaremit reserves the right to refuse, not process, or limit the amount of a transaction, whether in whole or in part. In the event that this happens, we will notify you as soon as possible through the means of communication available.
7.Regulatory Compliance and Additional Checks
In order to comply with applicable regulations, including but not limited to Anti-Money Laundering, Countering the Financing of Terrorism and Preventing the Financing of the Proliferation of Weapons of Mass Destruction (AML CTPF), we may request additional information or documents from you at any time, including delaying certain transactions for further verification purposes.
8.Changes to the Service
We reserve the right, from time to time, to suspend, modify, add, or discontinue part or all of the services, whether temporary or permanent, with or without prior notice to you. Any such changes will be notified through Adaremit official platform and deemed to have been known by you at the time of publication.
9.System Maintenance and Technical Changes
We may perform periodic or emergency maintenance of Adaremit systems or applications, which may result in temporary unavailability of services. In this case, we will endeavour to notify you in advance and restore access to the service as soon as possible.
10.Company's Rights to Information and Termination of Services
You understand and agree that Adaremit may rely on the information you provide as true and lawful information. Adaremit reserves the right, but is not obligated, to terminate this agreement and/or terminate your access to the services, with or without prior notice, in the event of a breach of these terms or if deemed necessary under our internal policies.
11.Account Suspension
We reserve the right to suspend or restrict your access to your account and services, in whole or in part, if we have reasonable grounds to suspect abuse, violations of the Terms of Service, violations of the law, or security risks that endanger our systems or other users.
Limitation of Liability
1.Compensation for Violations by Adaremit
If Adaremit is found to be in breach of these Terms and such breach directly causes you any loss, then we will use our reasonable best efforts to refund the amount of transaction funds and service fees paid, to the extent that it is legally proven that the breach was entirely negligent or faulty on our part.
2.Documentation of Claims
Any compensation request, refund claim, or complaint you submit to Adaremit must be accompanied by relevant and valid supporting documents and evidence. We reserve the right to verify such claims before deciding on any compensation.
3.Limitation of Our Liability
In using Adaremit services, you hereby understand and agree that, to the fullest extent permitted by applicable law, we shall not be liable for any loss, damage, or consequence arising, directly or indirectly, from the following:
-Failure in Transaction Execution
Failure or delay in processing or executing your transaction instructions caused by circumstances beyond our reasonable control (force majeure), including but not limited to: •Technical or system outages, •Extraordinary events that cannot be predicted or avoided, •Failure or delay of third-party communication or operational systems (including correspondent partners and technology infrastructure providers).
-Errors Due to Inaccurate Information
Any errors, inconsistencies, or interruptions in the site, application, or service system that arise as a result of incorrect, incomplete, misleading, or unupdated information provided by you or by any third party acting on your behalf.
-Limitations on Officer Roles
You agree that employees, agents or affiliates of Adaremit have no personal interest in any transaction or contractual relationship between you and Adaremit. They act solely as official representatives of Adaremit. The services provided by Adaremit are provided as is (as-is basis), without warranty of any kind, unless required by applicable law.
